October 31, 2018: Won a final divorce in DeKalb County for a client against a spouse who lived outside of the United States. Had to accomplish service in a foreign country.
October 19, 2017: Obtained generous visitation and decreased child support for unmarried father who had not been allowed to see his daughter.
September 25, 2017: In a successful trial, secured a favorable order in a divorce. Our client's wife had been seeking about $150,000 in alimony - he does not have to pay any alimony.
May 31, 2017: Prevailed in Cobb County Superior Court in a dispute over Jurisdiction. Our client's home was in Canada. Her husband wanted to resolve child custody in Georgia. We obtained an order from the Court that Canada had exclusive jurisdiction to decide custody.
April 20, 2016: Was able to win an order awarding full custody to a client vs. her abusive Husband. Won confirmation of an out of state child support arrears order. Father was granted no visitation rights because of his abuse.
April 4, 2016: Gwinnett County Superior Court. Won a battle regarding an opposing party’s request for Attorney Fees. The opposing party had asked for $7,265 in fees. After considering our brief, the Judge ordered that neither party would have to pay the other’s attorney’s fees – exactly what our client had requested.
February 10, 2016: won a contested child support modification case, reducing client’s child support from $1,000 per month to $515 per month. Fulton County.
December 2, 2015: obtained the dismissal of a Temporary Protective Order against a client in Clayton County Superior Court.
October 15, 2015: Obtained a contempt order and a cash payment of over $3,000 in a child support arrears case. Won attorney fees to be paid by other parent. Obtained an order dismissing the other parent’s claim for physical custody of the parties’ son.
October 14, 2015: Defended a contempt claim against a client who had over $10,000 in child support debt. Client was not incarcerated, and will repay the amount owed at the rate of $100 per month.
August 27, 2015: Obtained $18,000 for a client for in a divorce case. The parties had been separated for over 15 years, and most of the substantial assets were in the other spouse's name.
April 30, 2015: Won a ruling for a Father modifying child support to be significantly less than the amount sought by Mother.
March 4, 2015: In what began as a contempt case against our client, obtained a ruling that ex-wife had to turn over client's personal possessions and $28,000 to client.
January 14, 2015: Won an order reducing client's monthly child support to $450 (with no additional payment for arrears). The prior order made him pay $867 plus $50 towards arrears of approximately $13,500. Also reduced the arrears to approximately $900, total, which is to be paid once the children are no longer eligible for support.
January 12, 2015: Negotiated joint custody (with decision making authority over sports and extra-curricular activities & sports) and generous visitation for a previously incarcerated dad, He had been divorced while in prison - the divorce did not give him custody rights or visitation with his children.
November 6, 2014: Child support case with the Georgia Department of Human Resources, child support services. They Department had been seeking over $1,000 in child support per month. Reached an agreement for child support to be approximately $600 and to begin in January. Client said "your presence made a world of difference with her (the DHS case worker) attitude, before she didn't listen to me or treat me like a human being."
August 14, 2014: Won a reduction in child support from $767 to $528.
August 8, 2014: Hired August 7. Client lives in a different state. Child custody dispute -- client has the children. Ex-spouse has filed three cases & had scheduled three different hearings, the first for Monday, August 11. Attorney was able to have two hearings consolidated and the one Monday indefinitely postponed. Also was able to secure permission for client to appear via telephone. Client was able to avoid missing three days of work and paying for multiple flights and hotel stays. Client was "ECSTATIC."
July 23, 2014: Obtained physical return of a parent's child by police. The Mother had withheld all contact between the Father and his son.
March 26, 2014: Obtained an order for primary physical custody, attorney fees and an arrest warrant against a Mother who moved to a different state with a client's son. She had ignored orders to allow visitation.
December 4, 2013: Successfully incarcerated a Father who owed more than $15,000 in child support and refused to seek work.
September 4, 2013: Won a contempt order against a Mother who had denied Father access to his daughter for two years. Mother ordered allow visitation, give Father all information about the child and to pay Father's attorney fees. The Mother has so far complied with the Judge's Order.
August 8, 2013: Two cases - in the first, the custodial parent had sought child support of $600.00 per month. We won an order from the Judge awarding $401 per month. In the second, the State of Georgia (DHR) wanted our client to pay approximately $1,000 per month in child support. Negotiated a $500 payment per month.
April 24, 2013: Won a child support award for client that did NOT include any of the deductions sought by the Father. Obtained the visitation sought by client, not the additional days the Father wanted. Most importantly, attorney was able to obtain an award of almost $20,000 for RETROACTIVE child support - not arrears - money from before there was any order for child support, to compensate the Mother for the funds she had spent on health insurance and childcare.
February 13, 2013: Obtained a dismissal of a Temporary Protective Order ("TPO") filed against a client.
January 28, 2013: Divorce final hearing - represented the Husband. The Wife sought $600 child support, plus $200 alimony. Won a ruling from the judge that client would pay $280 child support and no alimony.
January 10, 2013: Kept a client out of jail in a contempt action over several thousand dollars in unpaid child support; won a ruling for a $50 per month repayment plan.
October 30, 2012: Obtained a reduction in alimony for a client from $1,200 per month for life to zero. Also got child support reduced from approximately $750 to $350.
August 29, 2012: Two different trials. Won a finding of willful contempt and an award of attorney fees against a parent for denial of visitation. In a DHR case, negotiated a $100 per month payment for approximately $52,000 in back child support, without interest.
July 31, 2012: Won custody of a child for a Father in Fulton County Superior Court.
July 3, 2012: Successfully obtained an order placing a Father in jail for non-payment of $89,000 in child support. Won Attorney fees for client.
March 16, 2012: Negotiated a successful change of custody and child support case.
March 13, 2012: Obtained a court order in Gwinnett County Superior Court, reducing a Father's monthly child support payment from $783 to $228.
February 28, 2012: Negotiated a divorce agreement for a client with two children. Arranged generous visitation and a $200+ reduction in monthly child support.
February 6, 2012: Submitted a brief which won a denial of client's ex-wife's attempt to have a child support order registered in Georgia. Case will properly be heard in his state, not Georgia.
October 17, 2011: Won a dismissal of a divorce case against a client because his wife forged a Settlement Agreement and Acknowledgement of Service.
October 3, 2011: Successfully defended against an attempt by a parent to reduce his child support obligation and obtained an order for our client's attorney fees to be paid by the other parent.
May 6, 2011: Obtained a termination of parental rights to protect children from an abusive parent.
April 21, 2011: Got a Father's child legitimated AND obtained for him primary physical custody and an award of child support.
March 10, 2011: Obtained a reduction in a client's alimony obligation - he will have to pay approximately $20,000 less than he would have.
January 13, 2011: Negotiated a reduction in a parent's child support obligation from $674 to $477, and obtained an additional week of summer visitation each year.
September 7, 2010: Obtained a court order reducing a Father's child support payment from $1,200 to $718, and reducing his child support debt from approximately $15,000 to $8,000.
June 14, 2010: Negotiated a solution to a child support arrears case: Eaton's client, the Father, owes $42,000 for 12 years unpaid child support. Obtained an agreement by which he will stay out of jail, the Mother's claim for interest was dropped, and the debt will be paid off at the rate of $400.00 per month.
March 3, 2010: Obtained temporary custody for a FATHER in a contested legitimation and custody case.
February 9, 2010: Obtained a divorce for a lady client who had been separated from her husband for about five years. She received primary physical custody, final decision making authority for the children and approximately $950 per month in child support. Also, she will receive 1/2 of any equity in the marital home, which was calculated to be in excess of $30,000. The husband had refused to provide any child support.
January 28, 2010: Obtained visitation order in contested modification case.
August 28, 2009: Won a ruling (based on the new child support statute) reducing a client's child support from $625 to $358 per month though his income remained the same.
July 16, 2009: Successfully obtained a ruling from the Superior Court of Fulton County, Georgia (Judge Bowens) that a client is NOT the legal or biological Father of his former girlfriend's child. Client will not have to pay child support.
July 7, 2009: Charles M. Eaton successfully petitioned the Superior Court of Fulton County, Georgia to dismiss a $65,000 back child support case against a Father on jurisdictional grounds.
On March 5, 2009: Mr. Eaton got a child support establishment case against his client dismissed in Fulton County Superior Court.
December 10, 2008: Newton County Superior Court: the Father of a client's child sought to pay $700 in child support per month. Mr. Eaton was able to prove that a reasonable obligation for him is $1,131.21. On February 25, 2009, Mr. Eaton received a ruling on behalf of his client that the Father must pay all of her attorney fees since December.
June 24, 2008: The Georgia Department of Human Resources took a client to court for "unpaid" child support exceeding $10,000. The result was a dismissal of the case without the client paying or owing any arrears. The monthly child support going forward was reduced and the client was entitled to receive his tax refund and other funds held in escrow by the department.
On April 2, 2008: Attorney Charles Eaton had a final hearing in a Paulding County, Georgia, Divorce. Before the Final, Mr. Eaton's client was paying over $1,600 per month alimony and child support under a prior Court Order (he had represented himself). He had no visitation. Mr. Eaton was able to secure a new Order reducing the total child support to less than $800 per month, and get him three days per week with his daughter.
