Property Deposit Recovery Lawyers in Dubai

A deposit is usually forfeited if the buyer defaults and returned, sometimes with compensation, if the seller defaults. The detail depends on the contract and who is in breach.

Who holds the deposit?

A broker, a trustee account, a seller or a developer. Identify who holds it and send written notice not to release. Release after a dispute is raised creates additional risk for the holder.

When is the deposit returned?

When the sale fails for reasons attributable to the seller, or when conditions precedent fail without buyer fault. The agreement and proof of defaults determine it.

Can a deposit be reduced?

A court can review an agreed forfeiture that exceeds the loss, in suitable cases. See sale agreement breaches.
