What loss can a business recover?
Direct, proven loss: replacement cost, wasted expenditure, lost margin on identified orders, and costs reasonably incurred to limit the damage. Speculative future profit and remote consequences are difficult to recover. Past trading figures make a lost-profit claim credible.
How do we prove it?
With documents, not estimates: invoices, purchase orders, bank records, management accounts and an expert accountant where the sum is large. The court may appoint its own expert. We prepare the figures so that the expert's questions have clear answers.
Does the duty to limit loss apply?
Yes. A claimant who could reasonably have reduced the loss and did not may see the claim cut. Record the steps you took, such as sourcing replacement supply. If the contract fixes compensation in advance, read our note on penalty and liquidated damages clauses.
